How it happened: For the second week in a row, D.C. United took the lead first from, once again, a converted penalty kick. As United worked to open things up in San Jose's box, Chris Korb was brought down while driving to the net and the refs awarded the Black-and-Red a penalty kick at the 10-minute mark.

Chris Pontius stepped up to take the honors and faked Earthquakes keeper Jon Busch into diving to his right early as Pontius sailed an easy shot into the netting. The tally would prove to be enough for three points as United notched their second win of the season, the first since their March 9 win over Real Salt Lake.

Good to be back: Pontius missed last week's 2-1 loss to Toronto due to a concussion during their Open Cup win over Philadelphia earlier that week. The converted PK was Pontius' first of the season.

Clean sheet club: The shutout was the fourth of the season for United, thanks to a stout effort by DCU's defense, who blocked seven shots and a dazzling performance from Bill Hamid, who had three crucial saves.?

What it means: It's a confidence booster. The three points doesn't allow United to climb over anyone in the standings, they're still firmly planted in last place, but with their improved play of late this could be the win that pushes things back on course.?

Celebrity chef Paula Deen to appear on TV's 'Today' after no-show

(Reuters) - American celebrity chef Paula Deen, who was dropped by TV's Food Network after she admitted in a lawsuit that she used a racial slur in the past, will appear on NBC-TV's "Today" show on Wednesday after canceling a scheduled interview last week.

The program's anchor, Matt Lauer, said on Monday's show that Deen "told us she will be here this time."

Deen, who withdrew from an interview on June 21, tweeted, "See you Wednesday, I am so glad Matt, Al and my friends at @TodayShow are bringing me back."

The program did not say if Deen would address the controversy.

Deen, 66, apologized in videos posted online for using a racial slur, but Food Network later said it would not renew the Southern chef's contract when it expired at the end of June.

The controversy surrounding Deen began last week when a deposition taken as part of a lawsuit was released in which Deen, who is white, was asked if she had used the "N-word," and responded, "Yes, of course.

Deen, who has built a business empire based on high-calorie and fried Southern food, with cookbooks, restaurants and kitchen supplies, made the comments in a deposition related to a racial and sexual discrimination lawsuit filed by a former employee.

The former employee of Paula Deen Enterprises, Lisa Jackson, is suing Deen and her brother, Earl "Bubba" Hiers, over allegations that while discussing plans for Hiers' 2007 wedding, Deen said she wanted a "true southern plantation-style wedding."

Jackson said that Deen used the slur in the discussion describing how she wanted an all-black wait staff for the party dressed in "long-sleeve white shirts, black shorts and black bow ties, you know in the Shirley Temple days, they used to tap dance around," she said, according to the lawsuit.

The Food Network is owned by Scripps Network Interactive Inc.

Stakeholders brace for White House move on power plant emissions

WASHINGTON (Reuters) - Before President Barack Obama unveils a plan to lower carbon emissions from thousands of existing U.S. power plants, stakeholders on all sides of the issue have attempted to make their mark on the regulations.

Electric utilities, environmental groups, large electricity consumers, and states have been working furiously behind the scenes for months to have a say in new rules that will be laid out by the Environmental Protection Agency.

Obama, in a video released by the White House on Saturday, confirmed that he will deliver a major speech on climate change on Tuesday. "I'll lay out my vision for where I believe we need to go - a national plan to reduce carbon pollution," Obama said.

Administration officials have said the White House will use the Clean Air Act to tackle power plants, which account for nearly 40 percent of greenhouse gas emissions.

This comes as no surprise to the companies and states that will have to either comply with or carry out the regulations. For the past few months, they have been working behind the scenes to influence the EPA before it begins what could be a months- or years-long rule-making process.

"The traditional industry response to EPA rule-making is - the EPA puts something out and then we respond to it," said Emily Fisher, a director of legal affairs for energy and environment at electric industry lobby group Edison Electric Institute (EEI). "This is different in that we feel obligated to be more engaged early on."

Fisher said the EPA will be in a "gray area" when it takes its first steps to regulate existing sources because the agency will need to use a rarely used and broadly worded section of the Clean Air Act, known as 111(d).

Under that statute the EPA would set federal emissions guidelines and decide upon the best systems or technologies for reducing emissions. Each state would then be left to set performance standards for its power plants and to determine how the plants will meet those standards.

Because there is little legal precedent for the rule, the agency will rely on a range of external sources for input, said Dina Kruger, a former director of the EPA climate change division and now a regulatory consultant.

EARLY START

Environmental group the Natural Resources Defense Council (NRDC) has developed the most detailed proposal so far.

In December it unveiled a plan in which the EPA would set state-specific emissions rates that would give the states most reliant on coal-generated energy more time to comply.

Dan Lashof, NRDC's climate and clean air program director, said the group wrote the plan to "rehabilitate the reputation of the Clean Air Act," which critics say will raise electricity prices, "and show there is a flexible way to regulate carbon."

Under the plan, a state that currently gets more electricity from coal-fired power plants than cleaner-burning natural gas or renewable energy would set an emissions rate target in 2020 that is higher than for a state that is less coal-dependent. States would then develop their own plans to meet the target.

The NRDC said its plan would cut carbon pollution 26 percent under 2005 levels by 2020 and cost $4 billion, which it said was a fraction of the cost of health and environmental damages from not acting on climate change.

But this approach may be vulnerable to legal challenges, said Robert Wyman, a lawyer at Latham and Watkins in Los Angeles who heads up a coalition of major companies that are also trying to influence the EPA rule-making.

The EPA "lacks the legal authority to differentiate among states in setting the eventual performance standards for specific fuel and technology subcategories," Wyman said.

The National Climate Coalition, which includes companies such as Boeing, Shell and utilities NRG and Midwest Generation, has developed a framework for the EPA that Wyman feels would stand up to potential legal challenges.

Under their approach, the EPA would set separate emission performance standards for coal- and gas-fired power plants.

"The EPA would develop the basic building blocks for coordinated state action while leaving to the states the choice of approach," according to a summary of their plan.

The NCC approach would let utilities calculate average emissions across their range of facilities, which in turn would enable states to use market-based mechanisms, such as trading of emissions permits.

EARLY ACTORS

Several states and certain utilities that have already taken steps to lower carbon levels at their plants will lobby the EPA to get credit for emissions already reduced under states' carbon reduction or clean energy programs.

Xcel Energy, which operates in states with renewable energy mandates including Colorado and Minnesota, estimates that its greenhouse gas reductions by 2020 will be three to four times greater than if it kept its fleet of coal plants and tried to maximize their efficiency under future EPA regulations.

States such as California and the nine northeastern states in the Regional Greenhouse Gas Initiative, which have market-based cap-and-trade systems in place, have also said they will seek equivalency.

The EEI also warned in a white paper on existing power plant rules in 2012 that while the EPA should give companies "flexible approaches" to meet the standard, "some are concerned that flexibility may open the door to more stringent standards."

Google ordered to delete 'Street View' data in Britain

The Information Commissioner's Office served?Google?Inc. with an enforcement notice, giving it 35 days to kill material captured in the project that featured camera-toting vehicles shooting images of the world's?streets.

To make sense of the pictures,?Google?had to be able to place precisely where the properties being photographed were located. Using a computer program, the vehicles taking the images used local Wi-Fi outlets to place the properties, and in doing so, collected snippets of data from the Wi-Fi networks.

The disclosure angered Internet users when it was first revealed in 2010, and Britain was one of several countries that launched inquiries. But it accepted?Google's?explanation that it had destroyed the material.

But last year,?Google?acknowledged that a handful of the discs had been discovered and the regulator promptly re-opened the investigation. US authorities raised concerns about the engineer who created the software.

However, investigators in Britain concluded there wasn't enough evidence on a corporate level to prove thatGoogle?had intended to collect personal data, and stopped short of imposing a penalty. In the United States, it paid a $7 million fine to settle a multistate investigation.

"The early days of?Google?Street?View?should be seen as an example of what can go wrong if technology companies fail to understand how their products are using personal information," Stephen Eckersley, the office's head of enforcement said in a statement.

The data regulator said the breach would have been worse had the data been disseminated.?Google?has insisted it was never examined.

Google?promised to comply with the order.

"We work hard to get privacy right at?Google," the company said in a statement. "But in this case we didn't, which is why we quickly tightened up our systems to address the issue. The project leaders never wanted this data, and didn't use it or even look at it."

The enforcement notice adds to the growing unease in Europe about whether?Google?was taking privacy concerns too lightly. France on Thursday gave the Internet search engine three months to be more upfront about the data it collects from users ? or be fined. Other European data watchdogs are also concerned.

Judge blocks audio expert testimony in Trayvon Martin case

ORLANDO, Florida (Reuters) - Two voice identification experts who suggested that unarmed black teenager Trayvon Martin screamed for help before he was shot and killed by George Zimmerman will not be allowed to testify at his murder trial, the judge in the case has ruled.

The ruling by Judge Debra Nelson was released on Saturday, marking the last major hurdle before opening statements in the high-profile case begin on Monday in Seminole County courthouse in Sanford, Florida.

Prosecutors had sought to call audio experts to testify about a 911 emergency call in which screams for help can be heard in the background during an altercation between Zimmerman and Martin before the shooting.

The screams could be pivotal evidence and help identify who was the aggressor on the night of the February 2012 killing. Zimmerman's family and supporters claim the voice was his, while Martin's parents insist the voice belonged to their son.

Last year, an FBI expert said a voice analysis of the call was inconclusive.

David Weinstein, a Miami lawyer and former prosecutor, called the ruling a victory for Zimmerman's defense team.

"Now there won't be a witness who can 'identify' the voice with certainty as a particular person," he said. "Each side can argue who they believe the voice belongs to and the jurors will have to decide who they hear."

Prosecutors say Zimmerman followed and confronted Martin despite a police dispatcher telling him not to pursue the 17-year-old. Zimmerman, 29, has said the two fought and that he shot Martin because he feared for his life.

An all-female jury will decide whether Zimmerman is guilty of second-degree murder, a charge that carries a potential life sentence. Zimmerman has pleaded not guilty.

Nelson said in her 12-page order that the decision does not prevent either side from playing the 911 tape and presenting witnesses familiar with Zimmerman's and Martin's voices from stating their opinions.

Lead defense attorney Mark O'Mara has called the recording "the most significant piece of evidence in the case."

Two state experts, in what they qualify as tentative or probable findings because of the poor quality of the recording, have said that the chilling screams heard in the background came from Martin.

Lawyers for Zimmerman, a former neighborhood watch volunteer, sought to block the testimony on grounds that the methods used by the state's voice recognition experts were based on questionable science.

Audio experts who testified for the defense in a lengthy pre-trial hearing argued that voice recognition techniques cannot identify an individual from screams made under extreme duress.

On Friday, the judge also dismissed a defense motion to bar certain words and phrases from the prosecution's opening statement.

She ruled prosecutors could allege that Zimmerman, who is Hispanic, "profiled" Martin but ordered them not to use the term "racial profiling."

Obama to nominate Democrat, Republican to FEC

WASHINGTON (AP) -- The White House says President Barack Obama intends to nominate two lawyers with government experience to become commissioners on the Federal Election Commission, the agency that oversees and enforces campaign finance laws. One of the nominees would fill a Democratic vacancy on the commission and the other would replace the current vice chairman, Republican Donald F. McGahn.

Obama's nominee to the Republican seat is Lee Goodman, who served as a top aide to former Republican Gov. Jim Gilmore of Virginia. Obama's Democratic nominee is Ann Ravel, the chair of the California Fair Political Practices Commission. She would fill the seat vacated earlier this year by Cynthia Bauerly.

If confirmed by the Senate, the FEC would have all of its six commissioners ? three Democrats and three Republicans.

WRC2: SkyDive Dubai driver Al Ketbi relishes delivery of new Ford Fiesta R5

Sassari (Sardinia): Skydive Dubai Rally Team driver Rashid Al-Ketbi and German co-driver Karina Hepperle have entered this weekend?s Rally d?Italia Sardegna, round seven of the 2013 FIA World Rally Championship, to gain more experience of top flight rallying in readiness for the delivery of their brand new M-Sport-prepared Ford Fiesta R5 in July. The Sardinia-based event runs from June 20-22.

?We are looking forward to driving in Sardinia ? not to score points in WRC2 but to gain a bit more experience and have some fun before we take delivery of the new R5 in July,? said Al-Ketbi. ?The car was launched recently and I am looking forward to getting hold of it before Rally Finland.?

The R5 has been built by M-Sport in the UK and is scheduled to be homologated by the FIA on July 1st. British driver Elfyn Evans is set to drive a factory version in Finland. The four-wheel drive Fiesta is powered by a turbocharged 1600cc engine and will compete in the WRC 2 category alongside Super 2000 and Regional Rally Cars (RRCs). Skoda, Peugeot and Citro?n are also developing R5 cars.

?With a proper driver this car is going to surprise a lot of people,? said M-Sport director Malcolm Wilson. ?It?s going to be quicker everywhere than a Super 2000 car and a lot of places it will be quicker than a regional car.?

The Skydive Dubai Rally Team is running in the 2013 WRC under the patronage of H.H. Sheikh Hamdan Bin Mohammed Bin Rashid Al-Maktoum, Crown Prince of Dubai and Chairman of the Dubai Sports Council, and is backing the UAE?s bid for EXPO 2020.

Qatar?s Abdulaziz Al-Kuwari currently holds a nine-point lead in the WRC2 category from Peruvian Nicolas Fuchs, while Volkswagen Motorsport?s S?bastien Ogier has a 52-point advantage over Finnish colleague Jari-Matti Latvala in the main Drivers? Championship standings. All four drivers line up alongside Al-Ketbi this weekend in an entry list that includes 14 World Rally Cars in a list of 56 entrants.

Rally d?Italia Sardegna has switched from a four to a two-day format and gets underway on Thursday morning with the Monte Pinu qualifying stage and the ceremonial start from the historic town of Sassari in the evening.

Friday?s action begins from the service park in Olbia and features a series of special stages en route to Sassari and the northern town of Castelsardo.

Saturday?s gravel stage action is centred around the picturesque forest areas of Monte Acuto and Gallura and the 16-stage event reaches a conclusion on Saturday evening at Olbia?s Molo Brin Archeological museum after around 304 competitive kilometres. The Mediterranean island has hosted a round of the WRC since the event switched from the Italian mainland in 2004.
